1. Agreement
These Terms & Conditions (“Terms”) are an agreement between you and Brayne LLC, a Missouri limited liability company, doing business as Clubhouse Maps (“Clubhouse Maps,” “we,” “us,” or “our”). They govern your use of our website and your purchase of products from our online store. By using our site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the site or order from us.
2. Who Can Order
You must be at least 18 years old to purchase from our store. By placing an order, you confirm that you are 18 or older and that the information you provide is accurate.
3. Our Products
We sell custom-designed map art, made to order. Because every piece is printed and framed individually for you:
- Colors and finishes may vary slightly from what you see on screen, due to differences in monitors, printing, and natural materials like wood frames.
- Product descriptions and images are provided to help you choose, and we work to keep them accurate, but small variations are part of a handmade, made-to-order product.
4. Pricing and Payment
- All prices are listed in U.S. dollars and do not include applicable taxes, which are calculated at checkout.
- We may update prices, products, and promotions at any time. The price that applies to your order is the one shown at checkout when you place it.
- Payment is processed securely through our payment provider (WooCommerce Payments, powered by Stripe). By placing an order, you authorize us to charge your selected payment method for the total shown.
- In the rare case of an obvious pricing or product error, we reserve the right to cancel the affected order and refund any amount charged, even after an order confirmation.
5. Orders and Acceptance
Your order is an offer to buy. We may accept or decline any order, and we may limit or cancel quantities. An order confirmation email means we’ve received your order, not that we’ve accepted it; acceptance happens when we begin production or ship your item. If we cancel an order you’ve paid for, we’ll refund you in full.
6. Made-to-Order Items and Cancellations
Every item is made to order, and production typically takes 3 to 5 business days. Because we begin printing your piece specifically for you, once an order enters production it cannot be cancelled or modified. If you need to change an order, contact us at info@clubhousemaps.com as soon as possible, and we’ll help if production hasn’t started yet.
7. Shipping and Delivery
We ship to the addresses you provide at checkout. Delivery time estimates are estimates, not guarantees, and we aren’t responsible for carrier delays once an item ships. Risk of loss passes to you when the carrier takes possession of your order. For full details, see our Shipping Policy.
8. Intellectual Property
All maps, artwork, designs, text, and other content on our site are the property of Brayne LLC (or our licensors) and are protected by copyright, trademark, and other laws. “Clubhouse Maps” and our logos are our trademarks.
When you buy a product, you may display it for your personal, non-commercial use. You may not reproduce, copy, resell, redistribute, or use our maps or designs for any commercial purpose without our written permission.
9. Your Account
If you create an account, you’re responsible for keeping your login information secure and for any activity under your account. Let us know right away if you believe your account has been used without your permission.
10. Acceptable Use
You agree not to use our site to do anything unlawful, to interfere with its operation or security, to attempt to access areas you’re not authorized to use, or to copy or scrape our content for commercial purposes.
11. Disclaimers
Our site and products are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties we are not legally required to provide. We don’t promise the site will always be available, error-free, or secure. This does not affect any rights you have under applicable consumer-protection law that cannot be waived.
Our maps are fine art made for decorative and informational display. They are not survey-grade and should not be used for navigation, determining property boundaries, or any purpose that requires surveyed accuracy. Minor color variations from what you see on screen are not considered defects.
12. Limitation of Liability
To the fullest extent allowed by law, Brayne LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our site or products. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Brayne LLC and its owners and team members from any claims, losses, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the site or your violation of these Terms.
14. Governing Law and Venue
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or your order will be brought exclusively in the state or federal courts located in St. Louis County, Missouri, and you consent to the jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above. Your continued use of the site or placement of an order after changes take effect means you accept the updated Terms.
16. General
If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with our Privacy Policy and Shipping Policy, are the entire agreement between you and us regarding your use of the site and your orders. We may assign these Terms; you may not assign them without our consent.
